The City of Lake Forest Park, Washington, uses automated traffic safety cameras for speed enforcement in school zones at several locations. If you are photographed exceeding the 20 mph speed limit then you will get a ticket in the mail for $124. It's tempting to think there is no defense to a ticket like this but the reality is: These tickets can be fought and won!
On December 6th 2010, Attorney Craig Cahoon represented a client on one of these tickets. Judge Portnoy, the Prosecutor and Mr. Cahoon argued about the matter for almost an hour before it became apparent that the city was going to be unable to prove the violation. Because of the nature of the defense's argument, the city will be unable to prove any of these types of tickets until they make some extensive changes to how the tickets are processed. While that is good news, if you do not contest your ticket then it will be found committed anyway.

Currently, the city uses a company in Arizona called American Traffic Solutions to process the camera information. Once compiled, the information is forwarded to a Lake Forest Park police officer for a determination of probable cause. The issue with these tickets has to do with the timing of when they are filed. Since state law sets strict time limits, this out-of-state process utilized by the city creates unintended consequences leading to dismissal of the underlying infraction.

One of the reasons why these tickets have been successful as revenue generators for the city is simply because people believe that it will be too expensive to hire a lawyer to fight a $124 ticket. In addition, if he cannot get your ticket thrown out then the $99 fee is waived; which means you do not owe Mr. Cahoon anything.
